Privacy and Communications

This section from our website's terms and conditions outlines how customer information is handled during the ordering process:

1. Data Collection: When customers place an order, certain personal and transactional information (such as name, address, email, and phone number) is collected. Importantly, credit/debit card data isn't stored or viewed by our company. Instead, it's handled securely by a certified payment gateway provider.
2. Security Measures: The payment gateways providers are certified as a PCI Service Provider Level 1, the highest level of certification available for handling payment card data. This certification ensures a stringent level of security in handling sensitive financial information.
3. Communication Method: To fulfil obligations and communicate with customers regarding orders and other related matters, your company uses email and website notifications. Customers agree to receive these communications electronically, understanding that these electronic forms satisfy any legal requirements for written communications.

The above three points are customers assurance that their information is handled securely during the ordering process and explains how communication about orders will be conducted, ensuring compliance with legal requirements for communication methods.

The contract between us

The process below clarifies the steps involved in making a purchase on our website, from you, the customer, placing the order to your company's acceptance and confirmation, culminating in the formation of a contract for the purchase of goods.

1. Order Placement: When a customer places an order through our website, it's considered a transactional offer from our company to sell the items. By making this order, customers, trade or consumers, confirm that the details provided (personal information, credit/debit card details) are accurate, current, and their own.
2. Order Confirmation and Contract Formation: Upon receiving an order, we send an email as confirmation that the order has been received. At this point, the contract between our company and you, the customer, is formed, indicating acceptance of the offer made by Peber Ltd to the customer.
3. Orders made by Peber to suppliers : We only order to any suppliers accepting their initial quotes by placing the order. Renewal orders have to maintain the original prices. We request a notice of a minimum one week for any increase and in all cases at time of orders. If products ordered are missing, the discount linked on volumes has to be maintained in all cases

B2C consumers 

As we are a B2B company and we do not deliver home consumers, but online orders are accepted to be collected with no minimum order or charge: We recommend that you purchase your items online and collect them on the day of the bake 2 days after fermentation from Peber at unit 4, The Park, Scorrier, Redruth, TR16 5FG which assures you of having your bread choice and avoid disappointment (except some of the collection orders ready as early as 15 minutes from order to be picked up ).

You can also pop to the shop at unit 4 and collect in person without an online order. However, this is subject to stock on site, which can be a great way of having a different daily loaf and a culinary surprise. Note that we address catering events, consumer functions for non trade deliveries with a discount coupont sent and no delivery charges over £100 drops, if your location is approved before hand.

Age Restrictions

We only sell items to adults (i.e. those aged 18 or over). If you are under 18, you may use this Website only with the involvement of a parent or guardian.

Colours, specifications, dimensions, and descriptions of products

We have made every effort to display the colours, specifications, dimensions, and descriptions of items on the Website as accurately as possible. The colours you see will depend on the resolution of your monitor. We cannot guarantee that your monitor’s display of any colour will always reflect accurately the colour of the item delivered, hence the fact that none of our pictures are not contractual. We may from time to time vary the dimensions, specifications, descriptions, and quantities of items displayed on our website without prior notice. 

Orders containing goods with personalised messages containing profanity or abusive language will be cancelled. Please note that we are unable to include emojis in our messages, and they will consequently be omitted.

Content & Intellectual Property Rights

The products and content on https://www.peber.co.uk/ are protected by national intellectual property. You are only allowed to use content found on this Website as expressly agreed by Peber limited t/a Peber and https://www.peber.co.uk/ . 

Peber is a trade mark registered with IPO any reproduction or redistribution of our content may result in civil and criminal penalties. In addition to these intellectual property rights, the content, defined as: graphics, photographs, image rights, sounds, music, audio, or text are to the best of our knowledge accurate and complete, however we cannot promise it is error-free. https://www.peber.co.uk/ cannot promise the functions within the site i.e. html, content and functional aspects are error-free.

You should also agree that no joint venture, partnership, employment, or agency relationship exists between yourself and https://www.peber.co.uk/. You will not express yourself as an employee, agent, or representative of Peber Ltd and we are not liable for any representation, act or omission on your part.

Online orders

All products sold on the Website are perishable items and as a result your statutory right to withdraw purchases within the seven working day ‘cooling-off’ period does not apply. The sourdough production starts one hour after the daily cut-off time of 2 pm to be baked usuallu 48 hours later after fermentation. You can cancel and be refunded up to 2.30 pm, not after as all the production process has been started for your order, mixing, fermentation etc by our algorithm implementing by our bakers all orders in a global production

Prices

Products are invoiced in GBP sterling at the price prevailing at the time you placed your order. Prices displayed on the Website, where applicable, include Value Added Tax which will be charged at the current rate. Whilst we try and ensure all details, descriptions and prices are correct when appearing online, some products might be subject to slight variations. Errors & omissions excluded.

Delivery charges may apply to orders placed on the Website.  Although we try to ensure that all prices on the Website are accurate, errors may occur. If we discover an error in the price of items you have ordered, we will contact you as soon as possible. You will have the option of either reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat your order in respect of the incorrectly priced item as cancelled.

Prices displayed on the Website apply to online purchases only. They are not indicative of the price of identical items purchased in our stores or by any other means. We reserve the right to update prices displayed on the Website at any point.

Payment

You may pay for the items which you order online by supplying your credit/debit card details the highest level of security, meaning your credit/debit card details are not stored by https://www.peber.co.uk/ . Should we need to issue a refund due to a price change or item being out of stock we will issue a refund via our payment gateway provider, or a coupon if it a partial refund. Depending on your bank, you will see the refund show up anywhere between 5-10 business days later.

We cannot accept cheques or cash for online payment. Only B to C can purchase in cash from unit 4 in a retail capacity. We accept card payments onsite. Credit accounts are considered once a relationship has been established, or from order 2 with a satisfactory credit check.

Please note that we cannot guarantee the security of data when communicating with https://www.peber.co.uk/ via email. Accordingly, please do not send us payment information using email. For details of the security measures used, please read our Privacy Statement. Unless fraud or negligence is established, we will not be liable to you for any losses caused as a result of unauthorised access to the personal and transactional information you provide us with when placing an order.

Cancellations

If you wish to change your mind or cancel your order, please contact us for cancellation within 30 minutes, up to 2.30 pm same day of order only. As soon as we receive the required notice of your cancellation of an order, we will refund the relevant part of the purchase price for that item together with the item’s normal delivery charge (or all of it if applicable). 

Click & Collect – Returns & Refunds

If the products you receive are not as you expect, please notify our office same day to: accounts@peber.co.uk  and/or return the product to the shop from which you collected it with its receipt and original unopened packing. Once we have received the product and confirmed that a refund is due, we will issue the refund. You DON'T have a legal right to change your mind & return bought goods, as stores don't legally have to refund you simply because you've changed your mind. (It's different if items are faulty, with the obligation to define "faulty", not only with your palate or taste buds but technical verifiable knowledge in our field. We are always eager to learn.)

We do not accept liability for returned packages damaged during transit back to us. It is your responsibility to wrap products adequately to prevent damage. Note that you have ample opportunity to try a sample before you bought, so any adverse comments based on your opinion or your palate, for this reason, will not be accepted based on this.

Losses

We will be responsible for any losses you suffer as a direct result of us breaching these Online Shopping Terms and Conditions if those losses were reasonably foreseeable to both you and us at the time the contract for the sale of items by us to you was formed (i.e. at the point we send the Order Confirmation email to you). We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions or the actions of our sub-contractors or agents, is consequential or was not reasonably foreseeable to both you and us when the contract between us was formed.

Our liability to you under these Online Shopping Terms and Conditions will not exceed the total price charged for the items purchased. Nothing in these Online Shopping Terms and Conditions excludes our liability to you for personal injury or death caused by our negligence.

Events beyond our reasonable control

We will not be responsible to you for any delay or failure to comply with our obligations under these Online Shopping Terms and Conditions if the delay or failure arises from any cause beyond our reasonable control.

Alterations to this Website and Terms and Conditions

We reserve the right at any time to make changes to this Website, these Online Shopping Terms and Conditions, Privacy Policy and such other policies as we may notify you of. You will be subject to the policies and terms and conditions in force at the time you use the Website or order items from the Website. Changes which we are required to make by law could apply to orders which you have already made. If any of the terms and conditions forming the contract between us are deemed invalid, void or unenforceable for any reason, it will be deemed severable and not affect the validity and enforceability of the remaining terms and conditions.

Waiver

If you breach these Online Shopping Terms and Conditions and we take no action we will still be entitled to use our rights and remedies in other situations where you are in breach.

Governing Law and Jurisdiction

These Online Shopping Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. You agree to submit to the non-exclusive jurisdiction of the English courts, as do we.
